Tangerine NBA Paris Games 2025 Contest Official Rules

The Tangerine NBA Paris Games 2025 contest (the “Contest”) is brought to you by Tangerine Bank (“Tangerine” or “Sponsor”) with its head office located at 100 Yonge St, Toronto, Ontario M5C 2W1. Contest is void in whole or part where prohibited by law. See Eligibility section below for further details. Participation in the Contest constitutes full and unconditional agreement and acceptance of these Official Contest Rules (the “Rules”) (which may be amended by Tangerine Bank from time to time in its sole discretion). All dollar amounts are in Canadian funds ($CDN) unless otherwise noted. Entrants acknowledge and agree that the NBA’s sole and exclusive role in the Contest is that of Prize supplier and that the NBA is in no way responsible for the administration of the Contest or the selection of winners.

1. Contest Period:

The Contest will begin on October 23, 2024  at 12:00:01 a.m. Eastern Time ET and will end on November 25, 2024 at 11:59:59 p.m. Eastern Time ET (the “Contest Period”).

2. Eligibility:

The Contest is open to legal residents of Canada who have reached the age of majority at the time of entry in their province/territory of residence and who are Tangerine Clients, except employees of Tangerine or any of its affiliates (including Scotiabank^®), NBA Properties, Inc., the National Basketball Association (the “NBA”), and the NBA member teams (collectively, the “NBA Entities”), and those with whom such employees are domiciled, shareholders, their advertising and promotional agencies, agents, mandataries, and immediate family members and/or those living in the same household of such employees (“Contest Parties”).

3. How to Enter:

No purchase or new Account opening necessary to enter or win. A purchase or new Account opening will not increase your chances of winning. Void where prohibited.

Eligible participants must enter during the Contest Period by hitting the ‘Enter Today’ button in the Contest communication presented to them upon logging in on the Sponsor’s website at tangerine.ca or on the Sponsor’s Mobile Banking app. 

There is a limit of one (1) entry per person. If it is discovered that an entrant has attempted to: (i) enter more than one (1) time; or (ii) use or attempt to use multiple names, Tangerine Accounts, or identities to enter, or otherwise participate in, the Contest, then in the sole and absolute discretion of the Sponsor the entrant may be disqualified from participation in the Contest. Use or attempted use of multiple identities, mail-in envelopes, and/or any automated system to enter or otherwise participate in this Contest is prohibited and is grounds for disqualification.

4. Prizes:

One (1) prize consisting of an NBA Paris Games 2025 experience as described below (the “Prize”) will be awarded to one (1) winner of this Contest.

The Prize consists of a trip for the Winner and a guest to Paris, France to attend one NBA game on January 23, 2025 and one on January 25, 2025. This includes round trip economy airfare for two (2) from an airport within 100km of the Winner’s home address as determined by Sponsor, five (5) nights of standard hotel accommodations (one double occupancy room) as determined by Sponsor, and $500. The approximate retail value of the Prize is $10,000. Any difference between the approximate retail value and the actual value of the Prize as taken will not be awarded. There is a limit of one (1) Prize per entrant during the Contest Period.

The hotel accommodations and flight times are subject to availability and black-out periods. Reservations are subject to complimentary allotment and may not be available even if a similar flight appears on the airline’s, or other airlines’ booking websites or through another airline. The Prize trip must be taken at the time and to the destination stipulated by the Sponsor or will be forfeited. The Winner and their travel guest must travel on the same itinerary and have valid travel documents (such as a passport) or the Prize will be forfeited. There are no deviations to travel allowed (i.e. length of stay, number of guests, flight stopovers, travel dates, etc.). All other costs and expenses associated with the Prize, including but not limited to, ground transportation between the Winner’s residence and the departure airport, additional accommodations or overnight layover if required, COVID testing if required, travel insurance, baggage fees, seat preselection fees, parking fees, meals and beverages, items of a personal nature, personal charges at lodging, and any other expenses not specifically described as included in the Prize are the responsibility of the Winner and their guest. No change in travel arrangements can be made once the booking has been confirmed. The Releasees will not be responsible for risk associated with any travel elements, including without limitation, air travel, cancellations, lost baggage, and quality of service provided by the airline, hotel staff and management, the trip organizers, or any other service providers.

The Winner’s guest must have reached the age of majority in their province or territory of residence prior to the trip unless the Winner is the parent or legal guardian of the minor guest.

Except at the discretion of Sponsor, the Prize is not transferable, assignable or convertible to cash (except as may be specifically permitted by the Sponsor in its sole and absolute discretion) and must be accepted as awarded. The Sponsor reserves the right to substitute the Prize in whole or in part if all or any of the components of the Prize are unavailable for any reason, including if the Winner doesn’t require airfare, with another prize of equal or greater approximate value, including, without limitation, but solely at the Sponsor's sole discretion, a cash award. In the event that the Winner is unable to redeem any or all of the Prize due to reasons beyond the control of the Sponsor, its employees, representatives, agents and all parties associated with this Contest, no compensation or substitution prize will be provided, and Sponsor may in its sole discretion award the Prize or the unredeemed portion of the Prize to an alternate Winner. Any costs or expenses incurred by the Winner in claiming or using any Prize except as described above will be the responsibility of the Winner. The characteristics and features of each Prize component, unless otherwise explicitly described above, are at the Sponsor’s sole discretion and are subject to change.

5. Prize Draw and Winner Selection:

A random draw will be conducted on November 26, 2024  at or about 12:00 p.m. ET at the Sponsor’s offices (the “Draw Date”). Odds of being selected will depend upon the total number of eligible entries received by the Sponsor during the Contest Period.

The selected entrant will be notified within one week of the Draw Date by the Sponsor by telephone or email and given instructions on how to contact the Sponsor to claim the Prize. The Sponsor will make a maximum of one (1) attempt to contact the selected potential Prize winner. If a selected entrant can’t be contacted within one week of the Draw Date, or if there is a return of any notification as undeliverable, the Prize will be forfeited and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate potential Prize winner from among the remaining eligible entries (in which case the foregoing provisions of this section will apply to the new selected entrant), and this process may continue until a potential Prize winner has been successfully contacted.

Before being declared a confirmed Prize winner (the “Winner”), the selected potential Prize winner will be required to: (a) correctly answer a time-limited mathematical skill-testing question; and (b) sign and return within 24 hours of receipt the Sponsor's declaration and release form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the Prize as awarded; (iii) releases the Releasees (as defined below) from any and all liability in connection with this Contest; and (iv) agrees to the publication, reproduction and/or other use of the Winner’s name, address (city and province), voice, statements about the Contest and/or photograph, image or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor or the NBA Entities or their designees and assigns in any manner whatsoever, including print, broadcast or the Internet and grants to the Sponsor and the NBA Entities, in perpetuity, a non-exclusive licence to publish, display, reproduce, modify, edit or otherwise use the material contained in the entry, in whole or in part, for advertising or promoting the Contest or for any other reason and waives all moral rights in and to the Winner’s entry in favour of the Sponsor. If a selected potential Prize winner: (a) fails to correctly answer the skill-testing question; (b) fails to return the properly executed release and other Contest documents within the specified time; (c) can’t (or is unwilling to) accept their Prize as awarded for any reason; and/or (d) is not in compliance with these Rules, then they will be disqualified and will forfeit all rights to the Prize and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate potential Prize winner from among the remaining eligible entries (in which case the foregoing provisions of this section will apply to the new selected entrant), and this process may continue until a Winner has been successfully awarded the Prize or until the Sponsor terminates the Contest in accordance with these Rules, whichever happens first.

6. General Conditions:

Anyone determined by the Sponsor to be in violation of these Rules for any reason is subject to disqualification in the sole and absolute discretion of the Sponsor at any time.

By entering this Contest, entrants accept and agree to be bound by these Rules, including all eligibility requirements and the decisions of the Sponsor and the independent judging organization, if any, which are final and binding without right of appeal on all matters relating to this Contest. All entries become the property of the Sponsor and will not be returned or acknowledged. Entries will not be acknowledged and no correspondence will be entered into except with potential Prize winners. The Sponsor reserves the right to disqualify any entrant who fails to comply with these Rules or who makes any misrepresentation relating to the Contest, the Draw and redemption of the Prize.

By participating, entrants release (and in the case of the confirmed Winner of the Prize, the confirmed Winner agrees to cause their guest to release) and hold harmless the Sponsor, the NBA Entities and all of their respective affiliates, directors, officers, employees, agents, representatives, successors and assigns, advertising and promotional agencies affiliated with this Contest, prize suppliers, participating establishments and any independent contest judges appointed by Sponsor (collectively the “Releasees”) from any claims, actions, injury, loss, or damage of any kind, including, but not limited to, illness, personal injury or death, resulting, directly or indirectly, in whole or in part, from participating in this Contest or from the acceptance, possession, or use or misuse of the Prize or any portion thereof (including any travel/activity related thereto). This limitation of liability is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation): compensatory, direct, indirect, or consequential damages; loss of data, income or profit; loss of damage to property; and claims of third parties.

The Sponsor won’t be responsible for any failure of email during the Contest or for any problems or technical malfunction of a telephone network or lines, computer online systems, servers, access providers, computer equipment, software, failure of any email, online, or Internet entry to be received by the Sponsor. In addition, the Sponsor won’t be responsible for technical problems, traffic congestion on the Internet or at any website, or any combination of these including any injury or damage to an entrant's or any other person’s computer or property related to or resulting from playing or downloading any material related to the Contest. The Sponsor reserves the right, at its sole discretion to cancel, suspend, extend or modify this Contest without notice, obligation or liability if in the Sponsors’ opinion there is any suspected or actual evidence of tampering with any portion of the Contest, or if virus, bugs, non-authorized human intervention, force majeure or other causes corrupt or impair the administration, security, fairness, or integrity and proper play of the Contest, or for any other reason in the Sponsor’s sole discretion. In such case, the Sponsor may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by the Sponsor. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest may be a violation of criminal and civil laws, and, if such an attempt is made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. Entries are subject to verification and will be declared invalid if they are illegible, incomplete, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way, or otherwise not in compliance with these Rules.

If a dispute arises regarding who submitted an entry, the entry will be deemed to be submitted by the authorized account holder of the email account provided at time of entry. Authorized account holder is defined as the natural person who is assigned to an email address by an Internet access or online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address.

The Sponsor won’t be responsible in any way for the use of, or bear any liability whatsoever in any way attributable to, the Prize awarded in this Contest or the events forming part of this Contest, including but not limited to typographical or other errors in the offer or administration of this Contest, these Rules, the selection and announcement of the Winner or the distribution of the Prize. The Releasees: (i) make no warranty, guaranty or representation of any kind concerning the Prize or any component of the Prize; and (ii) disclaim any implied warranty or condition.

In the event of any discrepancy or inconsistency between the terms of these Rules and the terms or statements contained in any short-form Contest rules, advertising materials and/or the French version of these Rules, the terms and conditions of these English Rules will prevail, govern and control to the fullest extent permitted by applicable law.

7. Privacy:

The Sponsor is committed to respecting the privacy rights of entrants. Any personal information collected will be handled in strict accordance with the Tangerine Privacy Code found at tangerine.ca and all applicable privacy legislation. The Sponsor won’t sell any personal information collected for this Contest to any third parties. Except as otherwise set forth here with respect to the Winner, any personal information collected for this Contest will be collected, used and disclosed by the Sponsor solely for the purpose of managing and administering this Contest. By entering this Contest, the entrant consents to the Sponsor's collection, use and disclosure of the entrant's personal information in order to manage and administer this Contest.

8. Governing Law:

This Contest is subject to all applicable federal, provincial and municipal laws. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of entrant and Sponsor in connection with the Contest, will be governed by, and construed in accordance with, the substantive laws of the Province of Ontario without regard to Ontario conflicts of law principles. All entrants consent to the jurisdiction and venue of the Province of Ontario.
